Terms of Use
These terms apply to the Koi Pond app for iPhone and iPad ("the app"), made by Ali Aldirsi ("we", "us"). By downloading or using the app you agree to them. They work alongside Apple's Licensed Application End User License Agreement (the "Standard EULA"). If the two conflict, these terms apply, as far as the Standard EULA allows.
1. Your licence
We give you a personal, non-transferable licence to use the app on Apple devices you own or control, as allowed by the App Store's Usage Rules. You may not copy, modify, resell, reverse-engineer or redistribute the app or its art, music and levels, except where the law allows it.
2. Purchases
The app is free to download. It offers optional in-app purchases, all processed by Apple through your Apple Account:
- Remove Ads: a one-time purchase that turns off banner and between-level ads on your devices.
- Koi Pond VIP: an auto-renewing subscription (monthly or yearly) that removes ads, gives unlimited hints and undos, and adds exclusive koi.
Subscriptions
- Payment is charged to your Apple Account when you confirm the purchase.
- A subscription renews automatically at the same price for the same period unless you cancel it at least 24 hours before the current period ends.
- You can manage or cancel subscriptions in your Apple Account settings, or at apps.apple.com/account/subscriptions.
- If an offer includes a free trial, any unused part of the trial ends when you buy a subscription.
Prices are shown in the app before you buy. Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. Use Restore Purchases in the app's shop or Settings to bring back purchases on a new device.
3. Hints, undos and other in-game items
Hints, undos, stars, collected koi and other in-game items have no cash value, can't be exchanged for money and can't be transferred. Because your progress is stored only on your device, it can be lost if you delete the app without a device backup. We can't restore it for you.
4. Ads
The free version shows ads from Google AdMob. Ads are provided by third parties; we don't control their content and aren't responsible for products or services they advertise. See our Privacy Policy for how ads use data and how to change your choices.
5. Fair use
Please don't use the app in a way that breaks the law, interferes with how it or its services work, or manipulates ads, purchases, Game Center scores or achievements (for example with cheats or automated tools).
6. Updates and availability
We may update, change or stop offering parts of the app. We'll try to make sure features you've paid for keep working, but we can't guarantee the app will always be available or work on every device or iOS version.
7. Disclaimer
The app is provided "as is" and "as available". As far as the law allows, we make no warranties beyond those stated in the Standard EULA. Nothing in these terms limits rights you have under consumer law that can't be excluded.
8. Limitation of liability
As far as the law allows, we aren't liable for indirect or consequential losses, or for loss of game progress or data, arising from your use of the app. Our total liability is limited to the amount you paid for the app and in-app purchases in the 12 months before the claim.
9. Changes to these terms
We may update these terms from time to time. We'll change the date at the top of this page, and by continuing to use the app after a change you accept the updated terms.
